CE marking is mandatory only for products covered by specific EU harmonised legislation; the manufacturer (or their authorised representative) is legally responsible for conformity, must compile a technical file, sign an EU Declaration of Conformity, and affix the CE mark before placing the product on the EU market. 

Overview — what CE marking means

CE marking is a legal declaration that a product meets all applicable EU directives/regulations (safety, health, environmental, EMC, etc.) that explicitly require CE. If no CE legislation applies, you must not use the mark and instead follow the General Product Safety rules.

  • Identify applicable EU legislation and harmonised standards for your product.

  • Decide conformity route: self‑assessment or involve a compliance expert.

  • Perform risk assessment and testing against essential requirements and harmonised standards; keep test reports.

  • Assemble technical documentation (technical file) demonstrating conformity (design, manufacturing, test reports, risk assessment, instructions).

  • Draft and sign the EU Declaration of Conformity (DoC) and affix the CE mark with required information.

Roles and legal responsibilities

  • Manufacturer: primary legal responsibility for conformity and marking; if you brand or import a product as your own, you are the manufacturer.

  • Importer / Distributor / Authorised Representative: have specific duties (e.g., verify DoC, keep documentation, ensure traceability).

When a compliance expert is needed

Sometimes manufacturers do not have the time or expertise in applying directives/regulations. If required, the compliance expert issues compliance report, checklists and certificates that are referenced in the DoC.
